Membership Terms and Conditions

These Terms and Conditions apply to all termly memberships purchased from Kaizen Kaikan Martial Arts School (“Kaizen”, “we”, “us” or “our”).
By purchasing a membership, the purchaser confirms that they have read and accepted these Terms and Conditions. Where the participant is under 18, the purchaser must be their parent or legal guardian.
1. Membership period
1.1 Membership is purchased for the specific school term stated on the Membership page or in the purchase confirmation.
1.2 Membership begins on the applicable term start date, or on the purchase date where a membership is purchased after the term has begun. It ends automatically on the final day of that term.
1.3 Membership does not automatically renew. A new membership must be purchased for each subsequent term.
1.4 Membership is personal to the named member and cannot be transferred, shared or resold.
1.5 Sibling Membership covers two siblings named when the membership is purchased.
2. What membership includes
2.1 Membership provides access to the Kaizen classes for which the member is eligible, subject to:
* the published timetable;
* the member’s age, experience and membership category;
* venue and class capacity;
* instructor availability;
* safety and safeguarding requirements; and
* any reasonable booking or attendance controls operated by Kaizen.
2.2 “Unlimited training” means that the member may attend eligible scheduled classes during the relevant term. It does not guarantee that every class, venue or preferred time will always be available.
2.3 Kaizen may make reasonable changes to instructors, venues, class times and the timetable. An occasional class cancellation or reasonable timetable change does not create an entitlement to a refund where suitable training remains available.
3. Fees and reservation of a place
3.1 The full membership fee is payable in advance.
3.2 Payment reserves a limited membership place for the entire term. Kaizen commits in advance to venue hire, instructor and operating costs and may refuse other applicants once capacity has been reached.
3.3 Membership fees pay for the right to attend eligible classes throughout the term. They are not calculated according to the number of classes actually attended.
4. Online cancellation period
4.1 Where the law provides a cancellation right for an online purchase, the purchaser may cancel within 14 days beginning on the day after the contract is confirmed, without giving a reason.
4.2 Cancellation must be communicated clearly by emailing *[office@kaizenkaikan.com](mailto:office@kaizenkaikan.com)*. The email should provide the purchaser’s name, the member’s name and the date of purchase.
4.3 If the purchaser asks for the membership to begin during the 14-day cancellation period, Kaizen may deduct a proportionate amount for the period during which membership services were supplied before cancellation. This applies whether or not the member chose to attend during that period.
4.4 Any refund due under this section will be returned using the original payment method within 14 days of Kaizen receiving the cancellation request.
5. No change-of-mind refunds after the cancellation period
5.1 Once any applicable statutory cancellation period has expired, membership fees are non-refundable except in the circumstances expressly stated in these Terms.
5.2 In particular, no refund or credit will be provided because the member:
* changes their mind or loses interest;
* decides that they no longer wish to attend;
* fails to attend available classes;
* goes on holiday;
* has examinations or other school commitments;
* experiences clashes with work, school or other activities;
* experiences ordinary transport difficulties;
* prefers a different instructor, venue or class time; or
* does not use the full amount of training available.
5.3 Absence from training does not cancel the membership or convert it into a pay-per-class arrangement.
6. Medical refunds
6.1 A pro-rata refund may be requested where, after purchasing the membership, the member suffers:
* a physical injury; or
* a serious illness or medical condition,
which prevents them from safely participating in all relevant martial arts training for at least four consecutive weeks or for the remainder of the term.
6.2 Kaizen may request reasonable written confirmation from an appropriately qualified healthcare professional. The confirmation need only state that the member cannot participate safely and the expected duration of that restriction; it does not need to disclose the member’s diagnosis.
6.3 Refunds will be calculated according to the unused complete portion of the term, beginning on the date Kaizen receives the written request and supporting evidence. Where the purchaser could not reasonably notify Kaizen earlier, Kaizen will take this into account.
6.4 Periods during which membership was available before the qualifying injury or medical restriction are not refundable.
6.5 Minor or short-term injuries which do not prevent all appropriate participation do not qualify automatically for a refund. Kaizen may instead offer modified training or a discretionary future-term credit where appropriate.
7. Cancellation or material changes by Kaizen
7.1 If Kaizen permanently cancels a membership programme, closes the relevant provision or makes a material change which substantially prevents the member from training, Kaizen will first attempt to offer a reasonable alternative.
7.2 If no reasonable alternative is available, the purchaser may cancel and receive a pro-rata refund for the affected unused portion of the term.
7.3 Individual class cancellations, instructor substitutions or reasonable venue and timetable changes will not qualify where the member continues to have reasonable access to eligible training.
8. Payment errors
8.1 Duplicate payments and amounts charged in error will be refunded in full.
8.2 If the wrong membership category is purchased, Kaizen may correct the membership and charge or refund the resulting price difference.
9. Exceptional circumstances
9.1 Kaizen may, acting reasonably, offer a future-term credit or pro-rata refund in genuinely exceptional circumstances, such as bereavement, an unavoidable permanent relocation or sudden severe financial hardship.
9.2 These requests will be considered individually. This section does not provide an automatic right to a refund.
10. Conduct and termination
10.1 Members must follow reasonable instructor directions and Kaizen’s safety, conduct and safeguarding rules.
10.2 Kaizen may suspend or terminate membership for serious or repeated misconduct, including abusive or threatening behaviour, deliberate damage, dangerous conduct, harassment, safeguarding concerns or illegal activity.
10.3 Where membership is terminated because of the member’s serious breach, any refund will be determined fairly, taking account of services already supplied, any reasonable loss caused by the breach and applicable consumer law.
11. Participation and responsibility
11.1 Martial arts training involves physical activity and an inherent risk of injury. Members must follow instructor directions and inform an instructor of any injury, illness or condition which may affect safe participation.
11.2 Members are not required to perform an exercise or technique which they reasonably believe they cannot perform safely.
11.3 Nothing in these Terms excludes or limits Kaizen’s liability for death or personal injury caused by negligence, fraud, or any other liability or consumer right which cannot legally be excluded.
12. Statutory rights
Nothing in these Terms affects the purchaser’s statutory consumer rights, including rights relating to services which have not been provided with reasonable care and skill or have not been supplied as agreed.

14. Governing law
These Terms are governed by the laws of England and Wales. Nothing in this section prevents a consumer from exercising any right to bring proceedings in another part of the United Kingdom where applicable.
