Kaizen Martial Arts – Terms & Conditions
1. Who We Are
Kaizen Martial Arts is a martial arts school operating in Southwest
London. These Terms & Conditions apply to all students, members and
visitors training with us or using our facilities.
2. Membership & Enrolment
- Membership/enrolment
is personal to the individual named and is non-transferable.
- Membership
commences on the date we accept your application / payment for the course
or membership.
- If
you join via a school-term membership (e.g. 8 – 12 weeks) you commit to
that term.
- Our
monthly membership is formed via 2 methods. The non-flexible option which
is based on 12 monthly payments across the year. This CANNOT be cancelled
during holiday periods. One month notice, in writing, is required for
termination. Any students that cancel during holidays and try to re signup
will have to pay a reconnection fee which is equivalent to 1 month’s
training.
- The
flexi bundle is the same as above but can be paused as you wish by giving
us 24 hours’ notice.
- 12
lesson bundles are nonrefundable and have an expiry date of 12 months
after students stop attending.
- We
reserve the right to amend the membership terms, fees or these Conditions
at our discretion. We will provide written notice of changes (e.g., email)
at least [14] days before the changes take effect.
- We
may refuse, suspend or cancel membership at our sole discretion for
breaches of these terms, misconduct, or non-payment.
3. Fees & Payments
- All
fees are payable in full and on time, according to the payment
schedule you have signed up to. If you require date changes, we can
accommodate this so please get in contact with us.
- Failure
to pay fees may result in suspension of training rights and/or
cancellation of membership.
- Any
outstanding arrears must be cleared before you may resume training. If you
have entered an arrangement to clear arrears, you must comply with that
arrangement.
- We
may increase our fees from time to time; we will give you notice [at least
14 days] before the increase takes effect.
- Any
promotional or discounted fee is subject to any terms set out at the time
of offer.
4. Training Sessions, Schedule & Facilities
- Training
sessions are provided at the times and locations as published from time to
time.
- We
reserve the right to alter training days, times, venues, instructors or
class structure at our discretion (e.g., due to instructor availability,
holidays, facility issues or events beyond our control).
- Where
classes are cancelled by us, we will make reasonable efforts to notify
you.
- You
must always follow the instructions of our coaches or staff and adhere to
all safety, hygiene and conduct rules in our facilities.
5. Health, Fitness & Medical Responsibility
- By
signing up you accept our assumption of risk, which is posted on our
website membership pages. Medical conditions or medications that may
affect your participation should be made known to the instructor.
- You
are responsible for ensuring you are physically fit and able to train. If
uncertain, you should seek medical advice before participating.
- If
you feel unwell or become injured during a session you must stop training
immediately and inform the instructor.
- You
must not train if under the influence of alcohol or non-prescribed drugs.
6. Conduct, Hygiene & Etiquette
- Good
personal hygiene is required: clean training kit, short nails, no
jewellery or accessory that may cause injury.
- Respect
your instructors, fellow students and training partners. Reckless,
aggressive or unsafe behaviour will not be tolerated.
- Bullying,
harassment, discriminatory or abusive language or behaviour is strictly
prohibited. We reserve the right to suspend or terminate membership for
serious or repeated misconduct.
7. Risk & Liability
- Martial
arts training is a contact sport and carries inherent risk of injury, loss
or damage. By participating you acknowledge and accept those risks.
- We
(Kaizen Martial Arts), our instructors, staff, owners or volunteers are
not liable for injury, loss or damage sustained by you, your property,
your dependants or your heirs, except in the case of proven negligence by
us.
- You
agree not to make any claim against us, our owners, instructors or staff
for injury, loss or damage arising out of training, other than in the case
of proven negligence.
- We
strongly recommend you obtain personal sports injury insurance in addition
to any compulsory insurance or licence requirements we may impose.
8. Junior (Under 18) Members & Safeguarding
- Children
under the age of 18 must be signed up to training by a parent or legal
guardian.
- Parents/guardians
are responsible for drop-off and collection and for the conduct of their
child before or after the supervised class time.
- Our
safeguarding policy applies to all junior members and vulnerable persons.
You may request a copy of our Child Protection / Safeguarding Policy.
- At 22
junior memberships will convert to adult status.
9. Facilities, Equipment & Personal Belongings
- Members
must treat our premises, equipment and property with respect and care.
- We
are not responsible for loss, theft or damage to any personal belongings
you bring onto the premises.
- You
may be required to wear or use approved training equipment or protective
gear. You must abide by any such requirements.
10. Data Protection & Privacy
- We
will store personal data securely and only use it for membership
administration, class scheduling, communication and legitimate business
purposes.
- We
comply with UK GDPR and other applicable data-protection laws. Our
separate Privacy Policy explains how your data is used and your rights in
respect of your personal information.
11. Cancellations, Freezes & Refunds
- Membership
cancellation by you must be made in writing (via email or letter) with the
required notice period (e.g., 30 days).
- Missed
classes are not eligible for refund (unless we cancel the class).
- In
the event of long-term injury or illness you may request a membership
freeze; any decision is at our discretion and subject to our freeze
policy.
- Refunds
for membership or classes are only as set out in our cancellation/freeze
policy and in accordance with relevant consumer law.
12. Rights of the School
- We
reserve the right to refuse membership, deny access to training sessions
or cancel membership at our discretion (e.g., for breach of terms,
misconduct or failure to pay fees).
- We
may, at our discretion, set, alter or remove class times, change
instructors, move venues, or modify our training programmes.
- We
will endeavour to communicate any significant change but cannot guarantee
it in all circumstances (especially in emergencies or “force majeure”
events).
13. Respect, Community & Values
- Members
are expected to uphold the values of Kaizen Martial Arts: respect,
integrity, discipline, continuous improvement, inclusivity and community
spirit.
- Any
behaviour (inside or outside the School) which damages the reputation of
the School, harms other members or undermines the training environment may
result in disciplinary action, suspension or membership termination.
14. Governing Law & Jurisdiction
- These
Terms & Conditions shall be governed by and construed in accordance
with the laws of England & Wales.
- Any
dispute arising under or in connection with these Terms shall be subject
to the non-exclusive jurisdiction of the courts of England & Wales.
15. Agreement
By attending classes, entering our premises or using our
services, you confirm that you have read, understood and agree to abide by
these Terms & Conditions.
